Again remember, you will not have to disclose to your employer any thing you were charged with that you were not found guilty of.
Does this effect me if I may have done some wrong things in the past? Employers also cannot ask about misdemeanors where the date of conviction or end of incarceration, whichever is later, happened five or more years ago, with no convictions since then. For the child in need of services cases you do not tell employers about the delinquency cases (Child in Need of Services),until Superior court takes it for criminal prosecution.
If the criminal record was sealed what it means to say? The good news is that the sealing of a record means that no one except people employed by the criminal justice system may ever have access to it. The charge basically only exists for the police and the courts, but for just about all other people, it’s really non-existant. There are some criminal records in MA that can be sealed. If they have been sealed, then most employers will be unable to view them during a CORI check. Remember, you do not need to inform an employer about a criminal record that has already been sealed.
How can you get your record sealed? The criminal record is elibible for sealing since all of the felony convictions have closed.
Since it has been 10 years of misdemeanor convictions have closed sine 15 years Definition: A case closes on the last day of prison, parole, or probation, whichever came last. You apply to have convictions sealed by filling out a form and mailing it to the Office of the Commissioner of Probation in Boston. Contact at 617 - 727-6558
How long would it take? There is no waiting period, but you will have to show that there is a “compelling governmental interest,” or a good reason, to seal the record. A good reason could be that the charges are preventing you from finding employment or housing.
